Terms of service

1. The service and the company

eroq.ai is operated by Qore Games, 9 rue des Colonnes, 75002 Paris, France ([email protected]). eroq provides access to generative models — text, image, video and audio — through an HTTP API and a Studio, metered in prepaid credits, plus a community where customers can publish what they made. The service is provided "as is"; models are probabilistic systems and no particular output is guaranteed. You must be at least 18 to use the service.

These terms form a whole with the Terms of sale (credit purchases), the Acceptable use policy and the Privacy policy. By creating an account or calling the API you accept all four.

2. Accounts and keys

You are responsible for your account, your API keys and everything generated with them, whether by you, your team or your end users. Keys are secrets: keep them server-side, rotate them if exposed. Accounts opened to get around a suspension, a ban or the multi-account limit are closed on sight, with every linked account.

3. Credits and payments

Credits are prepaid and do not expire. Failed generations are automatically refunded in credits. Purchases, taxes, delivery and the withdrawal right are governed by the Terms of sale, money refunds by the Refund policy. Payments are processed by Stripe and NOWPayments; we never see your card number or wallet keys.

4. Your content and your outputs

"Your Content" is everything you send us: prompts, chat messages, reference images, videos and voices, uploads to your Store, and the settings of each request. "Your Outputs" are the images, clips, voices and text the models produce from Your Content.

You are solely responsible for Your Content and Your Outputs. The models execute your instructions; what you ask for, what comes out and what you do with it are your decisions and your liability. You represent and warrant that you own or hold every right, licence and consent needed for Your Content and its processing; that Your Content and Your Outputs depict no one under 18 and no real, identifiable person without that person's documented consent; that they are legal wherever you and your users are and infringe nobody's rights; and that you will not use Your Outputs to harass, defame, deceive or impersonate anyone.

Prompts belong to you, outputs belong to you to the extent the law allows. We never use them to train models, for advertising or for marketing. What we keep, for how long, and how you delete it — your library, your references, the usage ledger, Private mode — is set out in the Privacy policy, which governs.

No one at eroq reviews a request or an output before it runs or reaches you. We keep the usage ledger, act on every report and moderate after the fact, and we may add automated screening of requests and outputs at any time; none of this makes an output that reached you our approval of it, or a confirmation that it complies with the law or the AUP. A request we refuse, cancel or filter is not a fault of the service.

5. Community, catalog and published content

Publishing a creation to the community, or a voice to the public catalog, makes it public: anyone can view it, and it may appear on eroq pages, in search engines and in our own promotion of the community. You grant Qore Games a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and distribute published content for those purposes, until you unpublish or delete it, subject to caches and backups. Our team looks at community posts before they go public; that check is a courtesy for the audience, not a legal review, and it does not shift responsibility for the post away from you. We may unpublish or remove anything, at any time, without notice.

6. Acceptable use and safety filters

Use of the service is bound by the Acceptable use policy. You must not attempt to bypass, probe or defeat our safety filters, age gate or moderation — by rephrasing, misspelling, encoding, splitting requests, or through any other technique. A blocked request is a warning, not a puzzle. Violations lead to suspension or termination; prepaid credits on accounts terminated for AUP violations are forfeited.

7. Building on the API

If you embed eroq in your own product, you are the operator of that product and the first line for its audience: you age-gate it, you pass this AUP through to your users with at least the same restrictions, you moderate what it publishes, and you comply with the consumer, data-protection and content laws that apply to it. Anything your users generate through your keys counts as Your Content and Your Outputs under section 4. We may suspend keys whose traffic breaches the AUP regardless of who typed the prompt.

8. Our role, notices and law enforcement

For content that customers store, publish or generate, Qore Games acts as a hosting intermediary within the meaning of Regulation (EU) 2022/2065 (Digital Services Act) and the applicable e-commerce rules: we store and transmit it at your request and do not author it. We are not liable for such content as long as we have no actual knowledge of its illegality and, once we do, we remove or disable access to it promptly. Anyone can report content at [email protected], giving its location and the reason.

Where the law requires it, illegal content — above all any sexual depiction of a minor — is not simply deleted: the file, the prompt that produced it and the account data behind it are preserved in a restricted quarantine and reported to the competent authorities (PHAROS in France, NCMEC in the United States, or the equivalent where you are). We cooperate with lawful requests from authorities and may disclose account data to them.

9. Availability and changes

We target high availability but do not warrant uninterrupted service. Model versions, prices and limits can change; price changes never apply retroactively to credits already spent. We may update these terms; the date above reflects the current version and continuing to use the service after a change means you accept it.

10. Indemnification

You agree to indemnify, defend and hold harmless Qore Games, its officers, staff, contractors and affiliates from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising from Your Content, Your Outputs, what you or your users publish, your product built on the API, your breach of these terms or your violation of any law or third-party right. This obligation survives the closure of your account.

11. Liability

The service and its outputs are provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, Qore Games' aggregate liability is limited to the amount you paid in the twelve months preceding the claim, and we are not liable for indirect or consequential damages, lost profits or data, or reputational harm. Nothing here excludes liability that cannot be excluded under the mandatory law of your country of residence.

12. Governing law

These terms are governed by French law; competent courts are those of Paris, subject to mandatory consumer jurisdiction rules. Mediation options are described in the Terms of sale. If a clause is held invalid, the rest remains in force.
